a) Contracting Parties: A contract is concluded between the customer and Adresskontor GmbH, represented by Jens Menzenbach and Werner Noisternigg, Am Höfel 1, 40885 Ratingen, Germany, Email: 
, Commercial Register: Düsseldorf HRB 89996, VAT ID: (applied for).
b) These T&Cs apply exclusively to entrepreneurs as defined in §14 BGB (German Civil Code).
c) Deviating terms of the customer apply only with the provider’s explicit written consent.
d) These T&Cs also apply to future transactions unless otherwise agreed.
a) Prices are based on data research, processing, and online delivery. Physical delivery is charged separately.
b) Prices are net and exclude statutory VAT, which is shown separately on the invoice.
c) Payment is due within 7 days without deduction, based on the invoice date. Deviations appear in the order confirmation.
a) Delivery is online via email or download link, deviations per order confirmation.
b) Data format is compatible with spreadsheet programs (e.g. Excel, OpenOffice).
c) Delivery requires full payment, though early delivery is possible. Partial deliveries may occur.
a) The customer receives a non-exclusive, unlimited right to use purchased data. If resold, use is transferred to one party, and the customer must cease usage.
b) Control/test data may be included.
c) Use is only permitted in accordance with applicable competition and data protection law.
d) Customer must verify compliance with data storage requirements independently.
e) The purchase does not include marketing consent (opt-in). §7 UWG applies. The customer must ensure compliance.
f) Customer is responsible for proper use, storage, and deletion of data.
g) Customer indemnifies provider from any third-party claims arising from use of data.
a) Data accuracy/up-to-dateness is not guaranteed due to external changes, though careful maintenance is ensured.
b) Provider may deliver up to 10% more data at no charge.
c) Customer must verify legal basis for advertising use and obtain necessary consents.
d) If data does not match offer specs, customer may request redelivery. If unsuccessful, they may withdraw or reduce the order accordingly.
e) Compensation claims are governed by section 6.
f) Warranty period is 6 months from final delivery.
g) No guarantee for completeness or correctness of addresses, phone numbers, or emails.
h) Data is from public directories and may contain errors. Return rates are not considered defects.
i) No assurance of recipient’s marketing consent. See 4e.
a) Provider is liable for damages (excluding injury to life/body/health) only in cases of intent, gross negligence, or breach of essential obligations.
b) Liability (excluding gross negligence/intent/life/body/health) is limited to foreseeable damages, up to 3× order value. This includes indirect damages such as lost profit.
c) Product liability remains unaffected.
a) If third parties claim against the provider due to customer’s legal violations, the customer shall indemnify and cover all costs (e.g. legal, expert, court costs).
The provider’s separate privacy policy applies.
a) Place of fulfillment is the provider’s business address unless otherwise agreed.
b) German law applies. International and UN sales law are excluded.
c) Jurisdiction is the provider’s location unless the provider opts for the customer’s location.
